Notice of Intent to Sole SourceSKM Power Tool Maintenance and SupportSolicitation Number: NB193000-19-02848The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with SKM Systems Analysis, Inc. for authorized SKM Power Tools Software maintenance and support services under other than full and open competition by the authority of FAR 13.106-l(b).This acquisition is for a multi-year (5) contract with SKM Systems Analysis Inc. The period of performance from 10/1/19 - 9/30/24. In March of 2017, NIST purchased SKM power tool software Combo Pack 1with1000 buses (DAPPER, CAPTOR, A-FAULT, Equipment Evaluation, IEC 363,IEC909, Arc flash evaluation) license #108666. The software is used to calculate the arc flash incident energy for personnel working on or near the energized electrical equipment. Maintenance services to include but are not limited to the following:• Provide diagnosis of

software problems or performance deficiency• Provide resolution for performance deficiency in the software• Provide copyrighted updates, release a new version of the software• Provide technical support for software application.From March 2017 to date NIST has required the proprietary technical support services from SKM Systems Analysis Inc. NIST now requires additional annual maintenance service for the technical support and software upgrades. Market Research shows that there are NO resellers that can provide this software maintenance service, this service is only provided by SKM Systems Analysis, Inc.This requirement is expected to be awarded in August 2019.The North American Industry Classification System (NAICS) code for this acquisition is 511210, and the size standard is $38.5 million in average annual receipts.No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 9:00 a.m. (EST) on August 12, 2019. Inquiries will only be accepted via email to maliaka.pinkney@nist.gov. No telephone requests will be honored.A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government.
