This notice also satisfies the FAR 5.201 requirement to notify the public of a proposed contract action.Description: The Department of Homeland Security, Federal Emergency Management Agency intends to negotiate on a sole source basis with Hughes Network Systems, LLC, 11717 Exploration Lane, Germantown, MD 20876-2700, for reserving an inventory of 100 VSAT Terminals for the whole of community, VSAT/Wireless Intranet services for one base year at the FEMA Headquarters Building, 500 C Street, S.W. Washington,

D.C. under the authority of FAR 13.106-1(b)(1). Soliciting from a Single Source because Hughes Network System is the sole provider with the capabilities to communicate within 24-48 hours of a disaster response anywhere in CONUS without Public Switched Telephone Network (PSTN) during a disaster with FEMA and National Leadership. Additionally, Hughes Communications is the only non-Department of Defense solution that can provide the ability to communicate without PSTN and communicate through an earth terminal with the "router in the sky" capability. A sole source justification has been prepared in support of this acquisition.Responses should include the firm's Tax Identification Number (TIN). Firms should identify business size (i.e. small business, other than small business, etc.) in accordance with the size standard for NAICS Code 51741 which is 1000 employees. This notice may represent the only official notice of such a solicitation. Soliciting from a Single Source because Hughes Network Systems is the sole provider with the capabilities to communicate without PSTN during an emergency with FEMA and National Leadership, or the area where our offices are located. Additionally, these services shall benefit disaster survivors in the affected area(s) by providing them with internet connectivity and the ability to communicate with family and other resources. A sole source justification has been prepared in support of this acquisition. Firms believing, they can provide these supplies or services above must provide written notification to the Contracting Officer with supporting evidence to that effect in enough detail to demonstrate the respondent's ability to meet the stated requirements. This notice is not a request for competitive proposals. All responses received within 5 calendar days of the date of publication of this notice will be considered by the Government. A determination by the Government not to compete this proposed action based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for determining whether to conduct a competitive procurement.
