N00164-18-D-WP05_P00003 - SOLE SOURCE - CONTINUOUS WAVE ILLUMINATION (CWI) TRAVELING WAVE TUBES (TWT) NEW PRODUCTION, REPAIR, AND REFURBISHMENT - FSC 5960 - NAICS 334419Issue Date: 16 OCT 2019 - Anticipated Closing Date: 15 NOV 2019 - 2:00 PM EDTITEM DESCRIPTION- Naval Surface Warfare Center (NSWC), Crane Division, Crane, IN 47522 has a requirement for the production, repair, and refurbishment of CWI TWT. The proposed contract action is for the modification of contract N00164-18-D-WP05 awarded to Communication and Power Industries (CPI), 811 Hansen Way, Palo Alto, California 94304 (CAGE 99313), to increase the contract ceiling amount from the original $14,200,000.00 to $20,000,000.00, an increase of $5,800,000.00.The requirements of N00164-18-D-WP05 are for the production, repair and refurbishment of Continuous Wave Illuminator Traveling Wave Tubes (CWI TWT) used in the MK99 Fire Control System for the AEGIS Program. N00164-18-D-WP05 has an ordering period that currently ends 05 JUNE
2023. The proposed contract action will not change the ordering period of N00164-18-D-WP05.FOR SOLE SOURCE PROCUREMENT- The Government intends to solicit and negotiate this modification with only one source, CPI (CAGE: 99313) of Palo Alto, CA under the authority of 10 U.S.C. 2304(c)(1) as implemented at FAR 6.302-1 Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements. This action is being sole sourced because the CPI Palo Alto is the only known source which has the capability to produce, repair, and rebuild the CWI TWT for use in the MK-99 FCS in the required timeframe.The TWT design was developed by CPI to meet the Navy's requirements of Weapons Specification (WS)-33400, which specifies performance, and NAVSEA Drawing 6155775, which specifies interface requirements. The design was based on an existing CPI design for a similar TWT; CPI has asserted restricted rights for this design. Although CPI has proprietary rights to the initial CWI TWT baseline design, the Government holds Government Purpose Rights to Government-funded design improvements to the CWI TWT. However, without the initial design, the Government-funded design improvements to the CWI TWT Technical Data Package (TDP) cannot be used independently to obtain competition. In addition to the restricted data rights on the initial design, CPI's manufacturing processes and production level drawings, which are critical in producing and repairing the TWT, are also proprietary to CPI.Any competitive action would have to be qualified, which is a lengthy process which takes an estimated 3 years and 6 months, and would incur unacceptable delays in fulfilling the agency requirement.All responsible sources may submit a capability statement which shall be considered by the agency. However, a determination by the Government not to compete with this proposed contract based upon responses to this solicitation is solely within the discretion of the Government.
