This RFP is issued in accordance with the Utah Procurement Code and applicable administrative rules of the Utah Administrative Code. If any provision of this RFP conflicts with the Utah Procurement Code or Utah Administrative Code, then the Utah Procurement Code or Utah Administrative Code will take precedence. Issuing Procurement Unit, Conducting Procurement Unit, and Solicitation Number USBE is the issuing procurement unit and conducting procurement unit for this RFP (referred to as “USBE”). The reference number for this RFP is Solicitation # USBE-MI24063-RFP. This solicitation number must be referenced on all proposals, correspondence, and documentation submitted to USBE relating to this RFP. Purpose of this Solicitation The purpose of this RFP is to contract with a qualified Offeror to serve as an educational partner to facilitate the development of both project-based learning tasks and performance assessments aligned to Utah’s science and social studies preschool to grade 12 (P-12) standards and the knowledge, skills, and dispositions. The intent is to create several examples available per grade level as models for teachers of effective instructional practice, to provide resources to educators that are of high quality and align to the rigor and intent of the state content standards, and to provide insight into student learning and understanding of the standards. The anticipated starting date of any contract related to this solicitation is June 2024. Please see the Scope of Work attached in the Buyer Attachments for further details. Contract Award It is anticipated this RFP will result in a single contract award to the responsive and responsible Offeror with the highest score justified by the Procurement Code. The contract resulting from this RFP will be for approximately two (2) years. However, USBE reserves the right to terminate the contract at any time in accordance with the provisions set forth in the USBE Standard Terms and Conditions. Contract Budget The maximum contract budget is a total of $696,637.00. However, this is NOT a guaranteed total amount. You are not required to expend the entire amount of funds when calculating your cost proposal. Cost proposals exceeding these identified amounts will be considered non-responsive and ineligible for contract award. Evaluations shall be based on the GRAND TOTAL for the two (2) years of the contract. Please note there is a separate tab on the Cost Proposal Form where you may provide pricing on any additional optional items that are NOT required to use your proposed solution and are NOT listed as a requirement in this RFP. These optional items may be subject to inclusion in the contract resulting from this RFP and may be purchased at USBE's option, but they will NOT be included in your Grand Total and will not be used in the evaluation of cost points. Additional Information Offerors are prohibited from communications regarding this RFP with the USBE staff, evaluation committee members, or other associated individuals EXCEPT the USBE procurement officer overseeing this RFP. Wherever in this RFP an item is defined by using a trade name, brand name, or a manufacturer and/or model number, it is intended that the words, “or equivalent” apply; and invites the submission of equivalent products by the Offerors. Description If applicable, Offerors may be required to submit product samples to assist the head of a procurement unit with independent procurement authority in evaluating whether a procurement item meets the specifications and other requirements set forth in the RFP. Product samples must be furnished free of charge unless otherwise stated in the RFP, and if not destroyed by testing, will upon written request within any deadline stated in the RFP, be returned at the Offeror's expense. Samples must be labeled or otherwise identified as specified in the RFP by the procurement unit. USBE reserves the right to conduct discussions with the Offerors who submit proposals determined to be reasonably eligible of being selected for award, followed by an opportunity to make best and final offers pursuant to the Utah Procurement Code and applicable administrative rules, but proposals may be accepted without discussions. Proposal Content and Evaluation The provisions of this RFP are not intended to limit a proposal's content or exclude any relevant or essential data. Offerors are at liberty and are encouraged to expand upon the specifications to demonstrate Offeror's ability to provide USBE with a solution. Each proposal received shall be evaluated as outlined in this RFP, the Utah Procurement Code, and applicable administrative rules in the Utah Administrative Code. To be responsive and responsible Offerors must review and respond to the following sections of this RFP: • Prerequisites: The Prerequisites section includes the prerequisites all Offerors must read and agree to in order to respond to this RFP. • Buyer Attachments: The Buyer Attachments section includes the standard contractual terms and conditions applicable to this RFP, as well as other documents associated with this RFP. • Questions: The Questions section contains questions to which Offerors must respond in order to submit a proposal. This section also includes the objective and subjective criteria that will be used to evaluate proposals, including mandatory minimum requirements and technical criteria. To determine which proposal provides the best value to USBE, the evaluation committee shall evaluate each responsive and responsible proposal that has not been disqualified from consideration under the provisions of the Utah Procurement Code and applicable administrative rules, using the criteria described in this RFP. Offerors must review each section carefully. After the evaluation and final scoring of proposals is completed, USBE shall award the contract as soon as practicable to the responsive and responsible Offeror eligible for award, subject to the Utah Procurement Code and applicable administrative rules, provided the RFP is not canceled in accordance with Utah Code Section 63G-6a-709(2)(b) and applicable administrative rules. Required to View Event Prerequisites Required to Enter Bid 05 April 2024 1. Offeror must guarantee its pricing for the period described in this RFP. 2. An Offeror may request that part of its proposal be protected by submitting a Claim of Business Confidentiality Form. See the Buyers Attachments section for a blank copy of the form. 3. All questions must be submitted through SciQuest during the Question and Answer period. 4. All notifications of an ambiguous, confusing, contradictory, or otherwise clearly erroneous solicitation provision must be submitted before the close of the RFP. 5. Offerors are encouraged to review this RFP prior to the deadline to submit a proposal, even if a proposal has been submitted, in case an addendum has been issued by the issuing procurement unit. 6. Proposals must be submitted electronically, through SciQuest. The issuing procurement unit may not accept a proposal after the time for submission of a proposal has expired. 7. You must ensure you have selected the appropriate time zone for your vendor profile. 8. The mandatory minimum requirements are the objective criteria by which the conducting procurement unit will evaluate proposals. Offerors must fully answer each and every question in the Questions section of this RFP and through their answers provide a point-by-point response to the mandatory minimum requirements. 9. To determine which proposal provides the best value to USBE, the evaluation committee will evaluate each responsive and responsible proposal that has not been disqualified or rejected using the subjective technical criteria detailed in the "Technical Evaluation Criteria" document attached to the Buyer Attachments section of this RFP. 10. Offeror's cost proposals will be evaluated independently. 11. If it is determined to be in the best interest of USBE, interviews and/or presentations may be held at the option of USBE. 12. All proposals in response to this RFP will be evaluated in a manner consistent with the Utah Procurement Code, Administrative Rules, policies and the evaluation criteria in this RFP. Offerors bear sole responsibility for the items included or not included within the proposal submitted by the Offeror. Each area of the evaluation criteria must be addressed in detail in the proposal. 13. Exceptions and/or additions to the Standard Terms and Conditions are strongly discouraged; however, Offeror may take exception and/or propose additional language to the Standard Terms and Conditions that have been attached to this RFP. 14. Any contract resulting from this solicitation may be modified to include new technology or technological upgrades associated with the procurement item. 15. Offerors shall not engage in unlawful conduct. 16. Group 2: Acceptance of Prerequisites Instructions: 2.1 Is Offeror presently or has Offeror ever been debarred, suspended, proposed for debarment, or declared ineligible by any governmental department or agency, whether international, national, state, or local? 2.2 If you answered yes to the question above, upload a statement regarding your debarment or suspension. 2.3 Please provide a list of all claims of non-performance or breach by customers in excess of $5,000, including all pending litigation matters (including civil, criminal, or appellate) or criminal convictions in the past 5 years for the company and all principals. If not applicable, please submit a statement indicating so. 2.4 Offeror acknowledges that it must acquire and maintain all applicable federal, state, and local licenses before the contract is entered into. Licenses must be maintained throughout the entire contract period. Persons doing business as an Individual, Association, Partnership, Corporation, or otherwise shall be registered with the Utah State Division of Corporations and Commercial Code. If yes, Offeror must provide a statement regarding its debarment or suspension. 2.8 Is Offeror an employee of the State of Utah? If yes, then Offeror must submit a dual employment form signed by Offeror's manager at the State of Utah. 2.9 In accordance with Utah Statute 63G-27-101, effective May 5, 2021, vendors contracting with the State to provide a good or service, including supplies, information technology, or construction services must certify they are not currently engaged in a boycott of the State of Israel and agrees not to engage in a boycott of the State of Israel for the duration of the contract (if awarded). Offeror is providing this certification in accordance with state law by selecting "Yes" to this question. 2.10 Exceptions to the attached Terms and Conditions are STRONGLY discouraged. Although not scored, all Offerors MUST indicate if they have any proposed changes or additions to any of the attached Terms and Conditions. Group 4: Stage 1: Mandatory Minimum Requirements - Compliance is MANDATORY Instructions: 4.1 Executive Summary: You must provide an executive summary that briefly describes your proposed plan. This summary should highlight the major features of the proposal and include a narrative description of how you will leverage the content leads and assessment developers to create model project-based learning experiences and performance assessments based on the Utah preschool to grade 12 (P-12) science and social studies standards and Utah’s Portrait of a Graduate (POG). Do you understand and agree to comply with this requirement? 4.2 Prior Work Experience: You must have at least three (3) years of experience developing project-based learning experiences and performance assessment. You must also have experience working with an SEA to develop educator resources such as project-based learning experiences or performance-based assessments. Please provide a narrative describing your experience in performing similar projects. This narrative must include, at a minimum: a) List of current and/or prior comparable projects; b) Narrative of work done on other state-level contracts demonstrating expertise with providing similar services; c) Resources that will be available for completion of the project; and d) Project/quality management systems in place. Do you understand and agree to comply with this requirement? 4.3 Work Samples: You must provide a minimum of two (2) work samples of project-based learning experiences and/or performance assessments that you have previously developed. Do you understand and agree to comply with this requirement? 4.4 References: You must provide reference letters AND contact information for no fewer than two (2) organizations that you have collaborated previously with on similar projects. You must include, at a minimum, a description of the projects that you worked on with these organizations. USBE reserves the right to contact one or more references to confirm the contents of your proposal, including qualifications. Do you understand and agree to comply with this requirement? 4.5 Proposed Team: You must provide a list of your proposed team members, including their individual qualifications, resumés, certifications (if any), and roles and responsibilities demonstrating their experience and expertise related to the services detailed in the Scope of Work. You must also provide an organizational chart for your company identifying key people who will work on the project. Do you understand and agree to comply with this requirement? 4.6 Detailed Project Plan: You must provide a detailed project plan that includes the goal(s), objectives, strategies, actions, and metrics to measure and assess progress required per the Scope of Work. You must detail how you plan to accomplish the Scope of Work, including who will do what you have proposed, what resources will be used to accomplish the Scope of Work, and any proposed modifications/additions to the Scope of Work. Please include a clear timeline, as well as the actions and deliverables to be completed each month during the project. Please also provide a description of the number of project-based learning and performance assessments per grade level that would be developed by the educator teams led by you, the educational partner. Do you understand and agree to comply with this requirement? 4.7 All deliverables and work completed under the contract resulting from this RFP that may be distributed to LEAs, schools, the public, or posted on the USBE website, must be compliant with Sections 504 and 508 of the Rehabilitation Act (codified in 29 U.S. Code § 794 and attached in the Buyer Attachments), as amended for the Workforce Investment Act of 1998 and Web Content Accessibility Guidelines (WCAG) 2.2 AA. Offerors are permitted to attach additional materials to their proposals in the Vendor Attachments section of this RFP, if necessary, to provide additional information to the evaluation committee, but each question MUST be answered in order to give the committee a complete, point-by-point response to each criterion identified in this RFP. Note that some specifications are MANDATORY, and Offerors MUST address and show compliance with all mandatory requirements. If at any time during the evaluation process it is determined that any of the following requirements have not been met, your proposal will be rejected. Offerors should also address optional features if applicable to their proposed solutions. Technical responses should follow the structure of the Technical Evaluation Criteria document to make evaluation easier. Upload your technical response to the Technical Evaluation Criteria here. If you need to attach additional documents, please do so in the Vendor Attachments. Group 7: Stage 3: Interview/Presentation Evaluation (IF REQUESTED BY USBE) Instructions: 7.1 At USBE's option, as part of your proposal, you may be required to interview and/or present and demonstrate your proposed solution to the evaluation committee during the evaluation phase of this RFP. Interviews/Presentations may be in person or via webinar. Because of the time-sensitive nature of this RFP, Offerors are expected to be able to be ready to interview and/or present their proposed solution within a few days of being notified of the exact available dates and times. Interviews/Presentations shall be evaluated in accordance with the requirements and criteria included in this RFP. Do you understand and agree to comply with this requirement? Group 8: Final Stage: Cost Proposal Evaluation Instructions: 8.1 The Cost Proposal Form you must complete and submit is located in the Buyer Attachments section. The Form must be inclusive of ALL costs of utilizing your proposed solution. In order to maintain consistency during the cost evaluation stage, deviation from this format may result in disqualification of your entire proposal. Please also submit separate pages detailing your per-year cost breakdown. You MUST still submit this completed Cost Proposal Form. Questions regarding the Cost Proposal Form should be submitted to the Q&A board during the designated Q&A period. Upload your completed Cost Proposal Form and supplemental documents detailing the per-year cost breakdown here. If necessary, you may upload supplemental documents in the Vendor Attachments section as well. Please note any cost information entered here will not be extrapolated by the system. The submitted cost will show as $0.00. 8.2 Costs entered into your required Cost Proposal Form MUST be all-inclusive. If travel for meetings, trainings, or other engagements is required, you must arrange and pay for your own transportation, meals, and lodging. Travel time and travel expenses shall NOT be included in any invoice to USBE. In the event that an Offeror offers pricing discounts for educational entities that result in lower pricing than what is generally offered to other governmental entities, please submit a Cost Proposal Form including the educational discount.
