NOTICE OF SALE Department of Natural Resources & Conservation Timber Sale The Olney North Timber Sale is located within Section 33 of T33N-R26W and Sections 5-8 of T32N- R23W on the State's Stillwater Unit. Approximately 32,729 tons, consisting of mixed conifer sawlogs, are offered for sale. Sealed bids will be opened at the Department of Natural Resources & Conservation, 2705 Spurgin Road, Missoula, Montana on May 16, 2024 at 2:00 p.m. Bids may be hand delivered or mailed and will be accepted any time prior to the bid opening. DNRC recommends that bidders contact the Trust Land Management Division (406-542-4300) prior to the bid opening to ensure that your bid has been received. Bids must be accompanied by a deposit of $39,639.00, representing 5% of the minimum bid value of the sale in cashier's check, certified check, bank money order or bank draft to be applied to the first sale invoice for the successful bidder. Bid bonds will be accepted and, for the successful bidder, will be
closed upon execution of the Timber Sale Contract and Timber Sale Bond. The sale will be awarded to the highest responsible bidder. If the successful bidder is unable to execute the contract within 30 calendar days from the date the sale is awarded, the bid deposit will be retained by the Department as liquidated damages. Bids must be submitted on Department of Natural Resources & Conservation (State) bid forms. 2. Timber will be sold to the highest responsible bidder; however, the State reserves the right to reject any or all bids. 3. The State recommends that bidders contact the Forest Management Bureau, Trust Land Management Division (406-542-4300) prior to the bid opening to ensure that your bid has been received. 4. A Bid Deposit must accompany all bids and must be in the form of cash, cashiers check, certified check, money order, bank draft, surety bond or irrevocable letter of credit. 5. The Purchaser must submit a Performance Bond to the State within 30 days of notification of sale award. The bond amount will be, at a minimum, 20% of the total bid value of the sale. The performance bond may be cash, irrevocable letter of credit, surety bond or certificate of deposit. The performance bond must be maintained separately from other payments for the duration of the Timber Sale Contract. See the Timber Sale Contract for additional information. 6. The purchaser must submit an Advance Stumpage Payment prior to cutting any timber. The amount of the advance stumpage payment will cover six weeks of harvesting and be based on the expected harvest rate and the bid value of the stumpage. The advance stumpage payment may be cash, irrevocable letter of credit, payment bond or certificate of deposit. 7. At rates specified in the Contract, the purchaser will pay Forest Improvement Fees on all sawlog volume. All applicable Road Use and/or Maintenance fees will also be paid by the Purchaser in addition to stumpage payments. 8. This sale is being sold based on the gross weight of all species. Minimum price and bid price are on a per ton basis. Unless otherwise specified, the price applies to all species, green and dead. Price may vary by product. Billing will be based on gross weight. A weight ticket from a certified scale is required for each load hauled, regardless of product type. 9. The State has estimated the net scale merchantable sawlog volume to be sold under this Contract. Other products may be part of this sale. All delivered wood will be weighed and billed at per ton bid rates. The State recognizes that a percentage of delivered wood may not meet the log manufacturing and recovery standards of the Timber Sale Contract. The actual percentage will vary based on the log manufacturing and recovery specifications of the purchaser and tree conditions in the sale area. The actual delivered weight may vary, resulting in an overrun or under-run of the estimated tonnage. The State strongly recommends that bidders evaluate these effects before bidding. 10. The State does not conduct detailed road appraisals. All appraised costs are gross estimates or averages, provided only to show the relative amount of work required, and not the true market value. The State strongly recommends that bidders make their own estimates based on Contract requirements. Cost estimates provided are not guaranteed. 11. PROSPECTUS Version January 2018 2 Additional Sale Information: 1. The Skunk Meadows Road is gated at approximately the 1.1-mile marker on the Upper Whitefish Road. A key for LOCK #2246 will have to be checked out at the Stillwater Unit Main Office. 2. The Olney North Timber Sale will require approximately 0.8 miles of new permanent road construction, 0.17 miles of new temp road construction, 0.7 miles of existing permanent road reclamation, and 8.6 miles of road maintenance. Additionally, this sale will involve 2 wet culvert installations, 3 super-gate installs (w/ 2 lock posts), three 24-foot flappers, one 20 foot flapper, gravel lifts, etc. as described in detail in the Olney North Timber Sale Attachment B. 3. 950 feet of new permanent road construction, “Stillwater Office Road”, is required to be built by October 1, 2024. (See Olney North Attachment B for further details and specifications) 4. There are multiple Winter Recreation Land Use Licenses held within the sale area. Extra coordination and mitigations will be required for harvesting and hauling in winter months. The extra coordination during the winter includes the following: • Harvesting and hauling in units 11 – 14 will NOT be allowed December 1 – June 15 annually, portions of units 7 & 8 where harvesting / hauling is tributary to groomed commercial lessees’ trails will also be restricted. • Log hauling must be conducted during the normal work week (Monday – Friday). Exceptions to this may be considered on a case-by-case basis by the Forest Officer. • Log hauling will not be conducted on holidays. • Communicate timelines, schedules, and changes with the Forest Officer allowing for time to make appropriate changes. • Snow plowing operations will leave 1 – 2 inches of snowpack on the haul route. • Feather edges of plowed snow berms for cross traffic on haul route. • Communicate directly with recreation licensees to deconflict traffic. • Logging operations will be restricted in units adjacent to trails used by licensees. • Extra traffic signs will be required at intersections. 5. Roundwood/pulp removal is required in all harvest units except units 2 & 3. In which, material that meets the minimum manufacturing and recovery standards for “other material” shall be removed from the cutting unit, skidded to the landing areas, and hauled. 6. Units 1A, 1B, & 1C are low sawlog volume units that have a large component of Post-&-Rail material (not estimated). 7. Units 1A, 1B, 1C, 5A, 5B, 7, 8, 10, 11, 13, 15, & 16 require mandatory Cut-to-Length (CTL) harvest systems, for 393 acres in total. Specific S.O.R.s for CTL apply. All other harvest units are whole tree skidding w/ the option for the Purchaser to use CTL instead. If CTL is selected, S.O.R. #5 for cut-to-length will apply. (See Olney North Timber Sale Contract for further detail.) 8. Units 5, 5A, 5B, 6, 9, 10, 15, & 16 have been Leave-tree-Marked with horizontal Orange paint stripes. All other units are “operator select leave trees based upon description”, as described in the Olney North Timber Sale Contract. 9. Slashing is required in units 1, 5, 5A, 5B, 6, 8 (~50 acres only), 12 & 14 totaling 345 acres. The State has appraised these costs at $20,000.00. Slashing may be achieved during logging operations but may also require additional hand work w/ chainsaws as directed by the Forest Officer. 10. A total of 88 acres will require Residential & Open-Road Hazard Reduction, in which 90% of all slash generated during harvest operations must be mechanically piled.
